These Terms of Service ("Terms") govern your use of the White Dolphin AI website and services. By using our services, you agree to these Terms.

1. Services

White Dolphin AI provides AI-powered receptionist services for businesses, including but not limited to automated call answering, appointment scheduling, lead capture, and customer communication. Our services are designed to supplement, not replace, your business operations.

2. Account Registration

To use our services, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Trial & Subscription

• Trial: We offer a 7-day trial for $1. During the trial, you receive full access to our AI receptionist service.
• Subscription: After the trial, your subscription automatically renews at the agreed-upon rate ($297–$497/month depending on your plan) unless you cancel before the trial ends.
• Setup Fee: A one-time setup fee of $1,500–$2,500 may apply for custom integrations and advanced configurations.
• Cancellation: You may cancel at any time. No refunds are provided for partial billing periods.

4. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Provide false or misleading business information for AI training
• Use the AI receptionist to make deceptive or fraudulent claims
• Attempt to reverse-engineer, copy, or resell our technology
• Violate any applicable laws, including telemarketing and consumer protection regulations

5. AI Disclaimer

Our AI receptionist is designed to assist with common business communications. However:

• AI responses may occasionally be inaccurate or incomplete
• The AI is not a substitute for professional advice (legal, medical, financial, etc.)
• You are responsible for reviewing and approving the information your AI receptionist provides to customers
• We are not liable for business decisions made based on AI interactions

6. Intellectual Property

All technology, software, and content created by White Dolphin AI remains our property. You retain ownership of your business data and content provided for AI training.

7. Communication Consent

By signing up for our services, you consent to receive:

• Service-related communications via email, phone, and text message
• Transactional messages about your account and billing
• Marketing communications (you may opt out at any time by replying STOP or contacting us)

Standard message and data rates may apply.

8. Limitation of Liability

To the maximum extent permitted by law, White Dolphin AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost revenue, missed calls, or business interruption.

9. Indemnification

You agree to indemnify and hold harmless White Dolphin AI from any claims, losses, or damages arising from your use of our services or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our website. Continued use of our services after changes constitutes acceptance.

11. Termination

We may terminate or suspend your access to our services at any time for violation of these Terms, with or without notice.

12. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.
